No. OI-11014/1/2007-DS. - The President is pleased to institute the Pravasi Bharatiya Samman Award in supersession of the notifications of the Government of India numbers 1/5/2002-Public, dated the 15th November 2002 and OI-11014/5/2006-DS, dated the 26th May, 2006 and for that purpose makes the following regulations, namely:-

1. The Award shall be known as "Pravasi Bharatiya Samman Award".
2. The Award shall be conferred on a Non-Resident Indian, Person of Indian origin or an organization or institution established and run by the Non-Resident Indians or Persons of Indian Origin, who has made -
   1. Significant contribution towards better understanding abroad of India and support to India’s causes and concerns in a tangible way;
   2. Significant contribution for the welfare of diaspora;
   3. Notable contribution in philanthropic and charitable work and for social and humanitarian causes in India and abroad;
   4. Significant contribution in building closer links between India and its diaspora in the economic, cultural and scientific fields;
   5. Eminence in one’s field for outstanding work which has enhanced India’s prestige in the country of residence; or
   6. Eminence in his skills which has enhanced India’s prestige in that country (for non-professional workers).
3. With the institution of Pravasi Bharatiya Samman Awards, Non-Resident Indians and Persons of Indian Origin shall continue to be considered for Padma Awards and Padma Awardees shall be eligible for Pravasi Bharatiya Samman Award.
4. The maximum number of Awards each year shall be fifteen (15).
5. The Award shall carry a bilingual Sanad under the hand and the seal of the President of India in addition to a citation and a gold medallion.
6. The Awards shall be presented at a formal ceremony to be organised by the Ministry of Overseas Indian Affairs, as far as possible, at the Pravasi Bharatiya Divas on 9th January every year.
7. The Awards shall be presented either by the President, Vice-President or Prime Minister depending upon the availability of these dignitaries.
8. The nominations of deserving persons, organizations or institutions shall be made by the following:
   1. Heads of Indian Diplomatic Missions abroad.
   2. Chairman of the Department Related Parliamentary Standing Committee of the Ministry of Overseas Indian Affairs.
   3. Prominent Overseas associations with nation-wide character as may be decided by the Ministry of Overseas Indian Affairs.
   4. Awardees of Pravasi Bharatiya Samman Award.
9. Deleted (vide Ministry’s Notification No. OI-11014/1/2007-DS dated 16th July, 2008).
10. There shall be no suo moto nomination by the Jury-cum-Awards Committee.
11. A Committee of officers, constituted by the Ministry of Overseas Indian Affairs, shall shortlist the recommendations to facilitate the work of the Jury-cum-Awards Committee.
12. The short listed nominations shall be placed before the Jury-cum- Awards Committee comprising of:
    1. Vice President of India – Chairman
    2. Minister of Overseas Indian Affairs – Vice-Chairman
    3. Principal Secretary to the Prime Minister – Member
    4. Home Secretary – Member
    5. Foreign Secretary – Member
    6. Five members to be nominated by the Prime Minister
    7. Secretary, Ministry of Overseas Indian Affairs – Member-Secretary.
13. The recommendation of the Jury-cum-Awards Committee shall be submitted to the Prime Minister and President for approval.
14. The names of the persons, upon whom the award is conferred, shall be published in the Gazette of India prior to the day of presentation of the awards.
15. The Awards shall not be given posthumously except in very rare cases where the person had died within a year preceding the announcement of the awards.
16. The President may cancel and annul an Award in the event of any adverse information on the awardees coming to light subsequently.
